, why all of the love? good morning, welcome to early state. i'm christine rom yans. >> and i'm john berman. it's january 28th it's monday. we'll begin with that developing story out of brazil. deadly chaos at a nightclub. early yesterday morning. killing a staggering 233 people. many of them college students celebrating their last weekend of summer break. it happened at kiss nightclub in santa maria. recovery workers now say they're hearing the eerie sound of ring tones. we're in santa maria with the latest. >> reporter: smoke filled the air when the first firefighters entered the nightclub. where shirtless men were already trying to rescue some of the injured. emergency vehicles arrived not realizing the extent of the tragedy they faced. chaos and terror among survivors and the body of victims all around. the fire broke out at about 2:00 in the morning at a nightclub called kiss in santa maria in bra sail's southern most state. the club was packed with some 2,000 people, twice its legal capacity according to officials >> translator: people who were inside the facility when they cam

ramsey. the case remains unsolved and now reports say a grand jury had voted to indict john and patsy ramsey. but the district attorney refused to sign the indictment, believing he could not prove the case beyond a reasonable doubt. an attorney for john ramsey says indicting him would have been a gross miscarriage of justice. >> this case was so huge back then. fascinating to learn that both parents were indicted. the legal question is, did the d.a. have a legal obligation to sign it under colorado law? because some analysts are saying he should have signed it and moved to dismiss the charges in open court. >> that's remarkable. i don't think i've ever heard of that. typically, what d.a.'s want to do is they want the grand jury to decide. because then the decision is not on you as the district attorney, it's on the people of the grand jury. it is like the tribe has spoken. so if you have a grand jury indictment, then even if you don't prove your case, you still have done your job. it's remarkable to me that you would get that indictment yet not sign it. >> it was such a high profile c

. >>> closing arguments will begin tomorrow morning in the trial of john leopold. today, the defense rested its case. leopold has charged with misusing county money, also have a security details driving him around to different location at which he is alleged to have had an affair. john leopold's lawyer says the accusation that he used police for accomplice cal and personal services is too vague and that it does not constitute a crime. >>> a maryland man walked into his estranged wife's workplace and shot her overnight. police say 50-year-old calvin cofield shot and killed himself. the victim survived, but she's in critical condition. that happened about 1:00 a.m. in the 300 block of harry truman parkway. >>> in maryland there's a new delegate. darren swain took the oath of office for the 24th district's seat following months of controversy surrounding that seat, which was previously held by tiffany austin. austin was removed from office back in october after she took plea deals in two cases of misconduct. greg hall, another nominee to replace her was blocked after reports of his criminal backgr
like durbin and schumer, liberal democrats going along with something with john mccain and lindsey graham, that's a pretty good sign that this will pass easily in the senate. i think one of the most intriguing stories is the fight for credit. i think there are going to be a lot of people headed by marco rubio who will want to get a lot of this credit. lori: on the political side but it also begs the question, right, greg, what happens to the millions of illegal immigrants already living and working in this country? will it put pressure on available jobs and other services like hospital care, et cetera, what do you think?. >> i don't think so. i would prefer to take a positive spin on this entire story. i think if you look at a country like japan which is a demographic train wreck with a huge deficit, much bigger than ours, we're adding lots of people who will pay social security taxes. who will pay other taxes. you're adding to our population i think a workforce that will actually help our fiscal issues far more than a country say like japan. lori: good comparison. help our fiscal
in the jon-benet ramsey case. reports that a grand jury actually indicted john and patsy ramsey in connection with the death. why did the prosecutor decline to try that case? >>> we begin with that tragic nightclub fire in brazil. mike taibbi has the latest. mike, good morning. >> good morning, savannah. it has been a dead lly combinatn in the past, a nightclub filled with revelers and pyrotechnics and few too ways to escape led to panic. in santa maria, it was packed with its usual saturday nightclub when, at 2:00 in the morning, disaster. a swift-moving fire filled the ground-floor club with thick smoke. witnesses said club security initially blocked several emergency exits, thinking p patrons were leaving without paying and that left only a few ways out. in the ensuing panic, some victims were trampled. most died of smoke inhalation. many witnesses told police this fire was triggered by the use of some incindiery device on stage. >> the band used fireworks and as we heard it was usual for this presentation but the ceiling was too short. >> reporter: some club goers who did make it out join
